CONTESTING WILLS AND
TRUSTS
      Under 755 ILCS _____,  any "interested person" may contest a will. "Interested persons"
include beneficiaries, heirs at law, the Illinois Attorney General when a charity is involved. Notice
of the admission of the will to probate must be given to all persons named on Exhibit A attached
to the petition to probate the will. A will contest must then be filed within six months of the date
the will is admitted to probate, with the only exception being omitted or unnotified heirs or
legatees.

      There are four ways to attack a will or a trust:

      Improper Execution or Lack of Formalities

      
Lack of Capacity

      Undue Influence

      Breach of Fiduciary Duty
